Land acquistion by sons of a partner of a company
Gautam Sharma at 12:31 a.m. on 14 April 12
Hi, Need help. The case is this. My father is a partner of a company (stone quarries, crushers). There are 3 partners (brothers). I partner passed away. All the property is in the name of "Company name in favour of the dead partner's name". Now sons of dead partner gets all the land converted in their names even though partners of the company are my father and my another uncle. We have proof of 3 partners and also have documents of all the land stating that the land belongs to the "Company name" but in favour of the dead partner. Is there a chance I can file a case. Currently it is being handled by the Block land reform office who are not revealin the case number. Pls help

For answering the your query, it is essential to have a look at the partnership agreement and to know if it is a registered partnership firm.

if the partnership is registered and proper stamp duty is paid than any such property would be a partnership property and it would cease to a property of single individual.
