purchase of agricultural land by a person from maharashtra in gujrat

my relative had a land earlier in maharashtra. in due course he got shifted to bhavnagar fro professional purpose and settled. lateron he purchased a agricultural land some 13 years back in the name of his mother. when his mother expired he approached authorities for legal heir mutation. the authority rejected his applicatiob on the plea that he has not obtained permission from collector prior to purchase of land. however the authorities have already mutated his mother's name in the records as an owner and now for legal heir mutation the authority is asking for permission from collector. and more over on the basis of this record , my relative has purchased another two agricultural lands which are also in the name of his mother.it is now surprising that the authority is giving reference of the provisions of bombay land revenue and tenancy act 1963/19+64. pl advise what is legal and fair. can a maharashtra person cannot buy property in gujrath and if so how the authorities have mutated my friends mother's name in records/
