My wife filed DV Act for maintenance after more 2 years from separation and working. Court passed an order for interim for Rs. 1500/- pm. I am not satisfied for this interim because my wife is not in immediate need because she filed after 2 years  clearly indication that wife is  not in immediate need. My wife is working women. but she denied in her statement. The basic condition for interim maintenace is "immediate need". 
My Question is that: Why magistrate passed order for interim maintenance while my wife is not entitled for this because she filed after 2 years.

The court can pass the maintanence order, for that period will not be considered.
But in your case,if you prove that your wife is working and earning sufficiently and she can take care of herself, then the court will set aside that order .
