My deceased mother who died in 1994 executed an agreement to sell in 1988 as an attorney of her father who died in oct 1988.The said property was mutated in the name of my mother in 1992.The vendee on the basis of that agreement to sell further executed an assignment deed in 1997. The property got mutated in my favour in 1996.The assigne has now filled a suit for specific performance for compliance of the agreement to sell as well as the assignment deed against me.The vendee/assignor has vide his written statement has denied of having taken possesion in suit premises as well as having received full consideration amount from the plaintiff .Please give your valuable opinion in the said matter.
