ICICI Bank not releasing leoned papers of the property even after full and final payment of housing loan taken.

I along with my husband took a housing loan for the purchase of a flat to be registered in my sole name(not in Jt name)from the ICICI bank, the property papers then were leoned to the bank. The loan has been fully paid now to the bank. The bank refuses to release the property papers on the plea that my husband has a bad unsecured loan(against stock)in the same bank, taken for business in his sole name. For your information, I am not associated in any way to the said business of my husband nor I am a guarantor to the said loan or my property given as security to the said loan or a benificiary of the said business or signed on any paper for that particular loan of my husband. The bank is refusing to release my property papers, sighting section 171 of Indian Contract Act.To my assesment this is wrong on the part of the bank and that amounts to arm twisting. Please advise me, what I should do under the circumstances.

a number of cases have been decided on this issue stating that if in loan documents it has been specifically mentioned that the bank shall have such a right & shall exercise then the bank is right but if no such thing has been in the loan documents for your loan then bank can not do this.
So please file a suit it will be decided early as a number of judgments even from SC are in their.
