Shri Rakesh Pandey, Advocate for the applicant. Shri Chandrakant Mishra, GA for the respondent/State. This is the first bail application filed by the applicant under Section 438 of the Cr.P.C. for grant of anticipatory bail. The applicant is apprehending his arrest in connection with Crime No. 252/2012 registered at P.S. Omti, District Jabalpur for the offence punishable under sections 420, 423, 467, 468, 471 and 120-B of the IPC.

Learned counsel for the applicant has submitted that the applicant has been falsely implicated in this case. On the particular day, the applicant went to Municipal Corporation, Jabalpur where his friend requested him to sign on the lease deed, therefore, he has signed the same in good faith. The applicant is a reputed citizen of the locality, in the event of arrest, his reputation will be tarnished, therefore, he be released on anticipatory bail. Learned counsel for the State has opposed the application and submitted that applicant is a near relative of Ashok Kumar. Ashok Kumar and Bhagirath Sharma were actively involved in the conspiracy of making the illegal and forged document, therefore, in the instant case the custodial interrogation of the applicant is necessary and the application is liable to be dismissed.

Considering the overall facts and circumstances of the case, in my opinion, it is a case in which the custodial interrogation of the applicant is necessary, thus, I do not find it a fit case to release the applicant on anticipatory bail. Application is hereby dismissed.
