Petitioners have filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 39 dated 14.6.2012 under Section 447, 427, 379 of the Indian Penal Code registered at Police Station Sadiq, District Faridkot.
Learned counsel for the petitioners have submitted that the petition qua petitioner No.1 has been rendered infructuous as he was arrested before passing of the order dated 13.7.2012. He has now been released on regular bail. While issuing notice of motion, following order was passed by this court on 13.7.2012:- "Notice of motion for 17.8.2012. Crl. Misc. No. M-20199 of 2012 (O&M) -2- In the meantime, in the event of arrest, the petitioners be released on interim bail subject to the satisfaction of the Arresting Officer. They shall abide by the conditions envisaged under Section 438 (2) of the Code of Criminal Procedure, 1973."
Learned State counsel, who is assisted by Assistant Sub Inspector Harinder Singh, has stated that in terms of the above order the petitioners No. 2 and 3 have joined investigation and are not required for further investigation. Accordingly, the interim bail granted by this court to petitioners No. 2 and 3 vide order dated 13.7.2012 is made absolute.
Petition stands disposed of accordingly. (SABINA)
