Shri Shanker Raju:

It is stated by the respondents that the applicants were the outsiders having not procured the OBC certificate from Delhi and the percentage is not bringing them within the merit of general candidate. In the light of the decision of Apex Court in Municipal Corporation of Delhi v. Veena & others, (2001) 6 SCC 571, such a candidate who holds the OBC certificate from outside is not entitled for appointment on reservation.

2. After hearing learned proxy counsel for respondents and proceeding the applicants ex parte under Rule 15 of CAT (Procedure) Rules, 1987, as nobody appears on their behalf, this TA is dismissed without any order as to costs.
