Section 403(f) in The Indian Penal Code
(f) A finds a valuable ring, not knowing to whom it belongs. A sells it immediately without attempting to discover the owner. A is guilty of an offence under this section. State of Madras, AIR 1958 SC 56. Ingreidents It has been held that the word ‘dishonestly’ and ‘misappropriate’ are necessary ingredients of an offence under section 403. Any dispute being about recovery of money is purely of civil nature. Hence a criminal complaint regarding such a matter is not maintainable, U. Dhar v. State of Jharkhand, AIR 2003 SC 974.
